Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and PHproxies ("we", "us", "our") governing your access to and use of the website https://phproxies.com, the customer dashboard and all proxy services we provide (together, the "Service").

By creating an account, adding funds, purchasing a plan or otherwise using the Service, you confirm that you have read, understood and agree to these Terms, our Privacy Policy, Refund Policy and Acceptable Use Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You may not use the Service if you are barred from doing so under the laws of your country or if we previously terminated your account. If you use the Service on behalf of a company, you confirm that you are authorised to bind that company to these Terms.

2. Your account

  1. You must provide a valid e-mail address and keep your account information accurate.
  2. You are solely responsible for keeping your credentials, recovery codes and whitelisted IP addresses secure, and for all activity that happens through your account or through any IP address you whitelist — whether or not you authorised it.
  3. Accounts are personal. You may not sell, share, sublicense or transfer your account, plan or balance to anyone else without our prior written consent.
  4. Notify us immediately at [email protected] if you suspect unauthorised use of your account.

3. The Service

  1. The Service gives you access to a network of residential proxy IP addresses supplied by third parties. IP addresses, their locations, availability and lifetime are not guaranteed and may change at any time.
  2. Access is authenticated by IP whitelist.
  3. Plans are sold by concurrent connections per IP: the maximum number of proxy connections that each whitelisted IP address may keep open at the same time, for the validity period of the plan. A "connection" is one open SOCKS5 session or HTTP / HTTPS tunnel, counted from the moment it opens until it closes. Connections above the limit are refused; this is not a fault of the Service. Any other limits — validity, number of whitelisted IP addresses, a total connection limit for the package, sticky sessions and, where stated, a traffic allowance — are described on the plan at the time of purchase.
  4. Each plan purchase creates a separate package with its own whitelisted IP addresses, limits and expiry. The same IP address may be whitelisted on several of your own packages, but not on another customer's package. Renewing a package extends that package; it does not create a new one. When a package expires or is suspended, its whitelisted IP addresses are removed and must be added again after renewal.
  5. Extra connections bought for a package raise the connections per IP of that package until the package's expiry as it stood at the time of purchase. Renewing or extending the package afterwards does not extend extra connections. Extra connections are not available for free trials, expired or suspended packages.
  6. We may add, change, limit or discontinue any feature, location, protocol, plan or connection pack at any time, with or without notice, and we shall not be liable to you or any third party for doing so.
  7. We may perform maintenance at any time. We do not guarantee any level of uptime and no service level agreement (SLA) applies.

4. Acceptable use

You agree to use the Service only for lawful purposes and in full compliance with our Acceptable Use Policy, which forms part of these Terms. You are solely and fully responsible for all traffic sent through the Service using your account, for the websites and systems you access, and for the consequences of that use. We act only as a technical intermediary and do not control, monitor in real time, endorse or take responsibility for the content you send or receive.

5. Payments and wallet

  1. Prices are shown in USD. Payments are made in cryptocurrency through third-party payment processors and are credited to your wallet once confirmed on the blockchain.
  2. You are responsible for sending the correct amount, coin and network to the correct address before the invoice expires. We are not responsible for funds lost because of a wrong amount, wrong network, wrong address, expired invoice, blockchain fees, exchange-rate movements or errors of your wallet, exchange or payment processor.
  3. Wallet balance is a prepaid credit usable only on PHproxies. It has no cash value, bears no interest, and cannot be withdrawn, refunded, exchanged or transferred.
  4. Plans, renewals and extra connections are activated immediately after purchase. Validity runs from activation whether or not you use the Service; connection capacity you do not use, unused days and any unused traffic allowance are forfeited when a package or extra connections expire and cannot be carried over, transferred or converted.
  5. Promotional credits, bonuses, coupons and trials may be changed or withdrawn at any time, have no cash value and may be revoked in case of abuse.

6. No refunds

All sales are final. Deposits, wallet balances, plans, renewals, extra connections and any other purchase are non-refundable under any circumstances, as described in our Refund Policy. Opening a chargeback, dispute or payment reversal is a breach of these Terms and will result in immediate termination of your account and forfeiture of all balances and services.

7. Suspension and termination

  1. We may suspend, restrict or terminate your account or access to the Service at any time, for any reason or no reason, with or without notice, including (without limitation) suspected violation of these Terms or the Acceptable Use Policy, abuse complaints, requests from authorities, fraud or payment risk, or to protect our network, suppliers or other customers.
  2. Upon suspension or termination for any reason, no refund, credit or compensation of any kind is due, and any remaining balance, packages, extra connections, plan time or traffic is forfeited.
  3. You may stop using the Service and ask us to close your account at any time; closing your account does not entitle you to a refund.
  4. Sections that by their nature should survive termination (including sections 4–6 and 8–13) survive.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, ANONYMITY OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY IP ADDRESS, LOCATION OR TARGET WEBSITE WILL BE AVAILABLE, UNBLOCKED OR FIT FOR YOUR PURPOSE, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US CREATES ANY WARRANTY.

9. Limitation of liability

  1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHproxies, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, SUPPLIERS AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, ACCOUNTS, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  2. Without limiting the above, we are not responsible for: actions of target websites (blocks, bans, captchas, account suspensions); actions of third-party IP suppliers, payment processors, blockchains or hosting providers; outages, slowness or data loss; unauthorised access to your account; or any legal, regulatory or contractual consequence of your use of the Service.
  3. IF, DESPITE THE ABOVE, WE ARE FOUND LIABLE FOR ANY REASON, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE THIRTY (30) DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
  4. Some jurisdictions do not allow certain exclusions or limitations; in that case they apply to the fullest extent permitted.

10. Indemnification

You agree to defend, indemnify and hold harmless PHproxies, its owners, operators, employees, contractors, suppliers and partners from and against any and all claims, demands, investigations, damages, losses, liabilities, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) any traffic sent through your account or whitelisted IPs; (c) your breach of these Terms, the Acceptable Use Policy or any law; or (d) your violation of any right of a third party. We are not responsible for, and you hold us harmless from, any consequence of the activity you carry out through the Service.

11. Cooperation with authorities

We may investigate suspected violations and may preserve and disclose account information, payment records and technical logs to law-enforcement agencies, courts or affected parties when we believe in good faith that it is required by law or necessary to protect our rights, our network, our suppliers or others.

12. Changes to these Terms

We may modify these Terms at any time by posting the updated version on this page and updating the date at the top. Changes take effect when posted. Your continued use of the Service after a change means you accept the updated Terms. If you do not agree, you must stop using the Service; no refund is due.

13. General

  1. Entire agreement. These Terms and the policies referenced in them are the entire agreement between you and us about the Service.
  2. Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent possible and the remaining provisions remain in full force.
  3. No waiver. Our failure to enforce any right is not a waiver of that right.
  4. Assignment. You may not assign these Terms. We may assign them at any time without notice.
  5. Disputes. To the maximum extent permitted by law, any dispute will be resolved individually — you waive any right to participate in a class, collective or representative action — and you agree to first contact us and try to resolve the matter informally for at least 30 days.
  6. Language. These Terms are written in English; any translation is for convenience only and the English version prevails.
